Gary Matthews Solicitors is a leading Company in the Plaintiff Litigation Services sector and is recruiting for capable Solicitor(s) and/or Barrister(s) to join their Plaintiff Banking Litigation Team on a full time basis. The Banking Division team has a Principal Solicitor based in Warrenpoint, County Down to whom the successful candidate will report.
Your new role
You will work within the Plaintiff Banking Litigation Division handling banking issues, including breach of contract, defamation, overcharging and loans which are considered “criticised”, meaning that the Plaintiff is in financial difficulty but it is hoped that the Plaintiff can be restored to a sound financial position.
The division comprises a Principal, two Solicitors, and c.6 support staff. The team’s office is in open plan format.
What you’ll need to succeed
Ideally you will be a solicitor qualified to practise in Ireland (or in Northern Ireland, England & Wales) with 5 years’ + PQE. Ideally, this would include litigation and/or some banking or insolvency law experience in a well-recognised firm, or failing that, property law experience.
About this role
The purpose of the Legal Counsel on the legal team is to provide legal support to the Banking team and external contacts to support the delivery of client’s instructions.
Key responsibilities
Litigation
- Complete all relevant legal documentation relating to client’s cases;
- Instruct barristers on the commencement and progress of proceedings;
- Communicate effectively to the business in relation to changes in legislation and legal policies and Court judgements;
- Make recommendations on cases based on input from external experts and internal reviews;
- Preparation of file audit for review by the Banking Division providing case progress and minutes.
Conveyancing
- Review title deeds to confirm good marketable title;
- Audit of title deeds inventory and tracking of deeds location;
- Liaise with the Banking team and panel barristers regarding the enforceability of mortgage charges;
- Work closely with the firm to assist in the rectification of deed issues;
- Management of file from inception of proceedings to conclusion.
Compliance through risk management
- Ensure all tasks are conducted in a manner compliant with all policies, procedures and legislative requirements.
Customer service
- Providing advice and guidance to the Banking team in relation to cases in the legal process;
- Support the business to bring high value, contentious litigation and conveyance cases to a satisfactory settlement and conclusion.
Analysis and reporting
- Lead, develop, enhance and maintain all reporting and analysis for the team including legal statistic, court case actions/results, legal costs etc.;
- Ensure weekly audit reports are completed within the set time frame.
Project involvement
- Involvement in a variety of projects as directed by management team which support the Firm’s overall strategy.
- Status reports monitoring progress of each case;
- Accuracy of legal documentation;
- Compliance with legislative and regulatory requirements;
- Monthly performance review of cases and success rates in relation to court proceedings;
- Compliance with monthly audits;
- Status reports monitoring progress of each case;
- Accuracy of information and appropriate actions taken thereby mitigating or eliminating risk and liability to Clients;
- Success is measured through achieving client goals and objectives.
Skills and experience
- Qualified Solicitor/Barrister (essential);
- 3+ years’ post qualification experience with a general practice background essential;
- Relevant legal experience gained in the areas of property and/or litigation;
- Previous experience dealing with receiverships;
- Knowledge of relevant mortgage legislation and industry requirements which may impact across the industry;
- Relevant legal experience gained in the financial services sector (desirable).
