Warrenpoint farmer fined £5,000 for non-compliance with Planning Enforcement Notice

A Burren pig farmer was this week fined £5,000 in his absence at Newry Magistrates Court for non-compliance with a DOE Planning Enforcement Notice.

Mr. John McCracken, of Ballyrussel Road, Burren was served with an Enforcement Notice to demolish the unauthorized structure and remove all associated rubble and reinstate the land. The Department previously refused planning permission for a piggery shed with slurry tank directly opposite 8 Ballyrussel Road, Warrenpoint and a subsequent planning appeal failed.

Mr. McCracken was convicted under Article 72 of the Planning (NI) Order 1991, as amended, as it is an offence to be in breach of an enforcement notice. A breach of a notice occurs where, at any time after the period for compliance has lapsed, any step required to be taken has not been taken.
